PLEASE READ THESE GUITAR CENTER LESSONS TERMS AND CONDITIONS ("LESSONS TERMS AND CONDITIONS") CAREFULLY AS THEY CONTAIN IMPORTANT INFORMATION ABOUT YOUR RIGHT AND OBLIGATIONS, AS WELL AS LIMITATIONS AND EXCLUSIONS.
THESE LESSONS TERMS AND CONDITIONS INCORPORATE THE FOLLOWING OTHER GUITAR CENTER POLICIES:
LESSONS SERVICES. These Lessons Terms and Conditions set forth the terms and conditions of your purchase of instructional services from Guitar Center Stores, Inc. ("GC Lessons").
TECHNOLOGY FEE. There is a one-time $30 non-refundable technology fee per student with this purchase, due at the time of initial purchase. In the event enrollment in GC Lessons is cancelled and not reinstated within ninety (90) days of the cancellation effective date, any reenrollment will incur another $30 non-refundable technology fee per student. All technology fees are per student, not per family. If more than one family member is enrolled, each member enrollment will incur the $30 non-refundable technology fee.
INDIVIDUAL LESSONS. The recurring tuition fee provides students with individual weekly lessons per month. The tuition package fee is billed monthly in advance to secure a student’s lessons with instructors.
TUITION. Each tuition fee entitles the purchaser to four (4) lessons. Lessons are scheduled once per week. Tuition package fees will be automatically charged to the payment method on file on the dates set forth below until such time as the GC Lessons are cancelled in accordance with these Terms and Conditions. After purchasing your first lessons package, your next lesson tuition package fee will be billed twenty-two (22) calendar days after the date on which your first lesson is scheduled. Thereafter, lessons tuition is billed every twenty-eight (28) calendar days (a "Billing Cycle"). For example: A student that initially purchases lessons on March 14th will be charged on March 14th for their first tuition package fee. At the time of purchase, that student will schedule their first 4 lessons. A student that schedules their first lesson for March 17th will be charged their next lesson tuition 22 days from March 17th regardless of whether they attend the lesson on March 17th (i.e. if they need to reschedule) and their next lesson tuition will be charged 28 days from April 8th (on May 6th) and then every 28 days moving forward.
Tuition does not include curriculum and material costs. We may increase monthly fees in future months upon 30 days’ written notice. If more than (1) lesson is scheduled per week, additional charges may apply (please contact your local store for details).
Tuition fees may be refunded in full prior to the delivery of any instructional services if your local GC Lessons location has received your request to cancel at https://www.guitarcenter.com/myaccount within 24 hours of your initial registration date.
PAYMENT AUTHORIZATION. You hereby authorize GC Lessons, or any of its affiliate companies to effect payment for approved fees and charges for the duration of your lessons through credit card automatic billing, which will be billed per these terms and conditions. This authorization is to remain in full effect until your local GC Lessons location has received your request to cancel at https://www.guitarcenter.com/myaccount prior to the upcoming bill date of the subsequent Billing Cycle. In the event the payment method on file is declined, you understand that we will attempt to charge the card each day for five (5) days. If the payment method is declined on the 5th day, your account will be automatically canceled, and any scheduled lessons will be automatically canceled.
REGULAR ATTENDANCE. Regular attendance is critical to the success of lessons. Please plan to attend all lessons and arrive on time and prepared.
LESSONS RESCHEDULE POLICY. To reschedule a lesson, you must provide at least 24 hours prior notice to your local GC Lessons location at https://www.guitarcenter.com/myaccount. We will reschedule your lesson subject to instructor availability. If you do not show up for a lesson or if you do not provide adequate notice, you will not have the opportunity to reschedule, and the lesson will be deemed forfeited. To encourage attendance and the use of lessons, all lessons will expire and be forfeited if not used within ninety (90) days after purchase. There will be no refunds or cash redemption available for expired lessons or forfeited lessons.
CANCELLATION OF ENROLLMENT. You may cancel your enrollment at any time. To cancel your enrollment and terminate your lessons, you must enter your request to cancel at https://www.guitarcenter.com/myaccount prior to the next upcoming bill date of the subsequent Billing Cycle.
Termination is effective on the date of notice. In the case of enrollment cancellation, all lesson tuition fees previously paid are non-refundable and any unpaid fees are immediately due. All unused paid lessons for cancelled enrollment accounts will expire and be forfeited thirty (30) days from the date of the notice of cancellation. There will be no refunds or cash redemption available for expired or forfeited unused lessons for canceled enrollment accounts.
GC Lessons may, at its option, cancel your enrollment if you (a) do not make timely payments; (b) you fail to show up without notice for 2 consecutive lessons; (c) your conduct is rude, improper, or harmful; or (d) you have not taken a lesson for 90 days.
POLICIES FOR COMMUNICATION. Communications between GC Lessons staff and with students must only be on site, at the facility, within GC Lessons systems, and directly related to instruction. Any other communication must be between the adult parent/guardian of any minor student and GC Lessons staff through GC Lessons operated phones, GC systems, and proper email addresses through GC Lessons. An adult parent or guardian must accompany any student under 12 years of age upon arrival and departure from every in-store lesson. Additionally, there are security cameras placed in the GC Lessons studios to capture the Lessons (video-only), to further ensure the safety of both students and instructors. By completing the registration, you consent to the use of security cameras in the Lessons studios.
LESSONS PERFORMANCES. From time to time, GC Lessons may record, photograph or video a student during recitals and other public performances to be used on Guitar Center websites and any other medium. By completing the registration, you consent to such use as a student or legal guardian of a student.
MODIFICATION TO LESSONS TERMS AND CONDITIONS. Guitar Center may modify these Lessons Terms and Conditions at any time. When we make changes to these Lessons Terms and Conditions, we will change the "Last Revised" date above. If a material change is made to these Lessons Terms and Conditions, we will post notice of that change on the first page of these Lessons Terms and Conditions. By completing registration, you agree to be bound by any such revisions, and you should periodically visit this page of the Site to examine the then-current Lessons Terms and Conditions by which you are bound.
SEVERABILITY. If any provision of these Lessons Terms and Conditions is held by a court of competent jurisdiction to be unenforceable for any reason, the remaining provisions hereof shall be unaffected and remain in full force and effect.
INDEMNIFICATION. You agree to indemnify and hold harmless Guitar Center and its affiliated companies against all costs, expenses, damages, losses, and liabilities incurred or suffered by Guitar Center or our affiliated companies resulting from any violation by you of these Lessons Terms and Conditions.
GOVERNING LAW. These Terms of Use shall for all purposes be governed by and interpreted in accordance with federal law and the laws of the State of California. Any disputes between us will be settled by final and binding arbitration in Los Angeles, California by. ANY ARBITRATION WILL BE ADMINISTERED BY NATIONAL ARBITRATION AND MEDIATION ("NAM") AND GOVERNED BY NAM’S APPLICABLE RULES (including the Comprehensive Dispute Resolution Rules and Procedures and/or the Mass Filing Supplemental Dispute Resolution Rules and Procedures, as applicable) as further described in the Guitar Center Dispute Resolution Policy.
HEADINGS. The section headings used herein are for convenience of reference only and do not form a part of these Lessons Terms and Conditions, and no construction or inference shall be derived therefrom.
